JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khaira P.S. Case No. 346 of 2019 (GR No. 3348 of 2019), registered for the offence under Sections 392 / 34 of the Indian Penal Code.

Three unknown miscreants assaulted the informant, tied his hands & legs with Gamachha and thereafter, snatched his motorcycle and fled away.

It is submitted on behalf of petitioner that name of the petitioner has transpired during course of investigation on the basis of confessional statement of co-accused Manav Kumar. No looted article has been recovered from the possession of the petitioner. Till date, petitioner has not been put on T.I.P. and he is in custody since 16.01.2021. Chargesheet has been submitted. Learned A.P.P. for the State has opposed the bail

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Khaira P.S. Case No. 346 of 2019.
