Petitioner is accused in connection with Manihari P.S. Case No. 103 of 2014 registered under Sections 341, 323, 379, 448, 376/511 and 34 of the I.P.C.

The accusation is that petitioner entered in the house of the informant Pratima Devi on 19.06.2014 early in the morning, at that time, she was sleeping along with her mother and this petitioner made attempt to commit rape, but the informant woke up and started raising hulla, upon which her mother caught hold the petitioner. Thereafter, Jagdish Parihar, Rambriksh Parihar and Ashok Parihar and their father, Devendra Parihar entered in the courtyard of the informant and assaulted to her mother by fists

Patna High Court Cr.Misc. No.7938 of 2015 (4) dt.02-09-2015 2/2 and slaps. In the meantime, Debendra Parihar also snatched the silver chain.

Learned counsel appearing on behalf of the petitioner submits that petitioner and informant are next door neighbour and due to family grudge and dispute, petitioner has falsely been implicated in this case only to take revenge to his father. It is submitted that petitioner is in custody since 27.09.2014, having no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Katihar in connection with Manihari P.S. Case No. 103 of 2014.
