The appellant along with three others was granted bail by this Court vide order dated 11.07.2017 passed in Cr. Appeal (SJ) No. 1554 of 2017 in connection with Gopalganj S.C./S.T. P.S. Case No. 13 of 2017 with a direction to them to surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of the
Patna High Court CR. MISC. No.7456 of 2021(2) dt.29-01-2021 2/3 order and furnishing bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount.
The learned counsel for the appellant has approached this Court through the present application seeking extension of time for surrendering before the Court below.
For the reasons stated in the application for the extension of time for surrendering before the Court below, the prayer is allowed.
The order dated 11.07.2017 is modified to the extent that if the appellant/Bachcha Yadav surrenders before the learned Court below within a period of four weeks from today, i.e., 29.01.2021, he shall be released on bail on his furnishing bail bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. District JudgeCum-Special Judge, Gopalganj in connection with Gopalganj S.C./S.T. Case No. 13 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Patna High Court CR. MISC. No.7456 of 2021(2) dt.29-01-2021 3/3 It is made clear that the other conditions as imposed vide order dated 11.07.2017 shall subsist. With the aforesaid modification, the application stands allowed.
