The petitioner seeks bail in Bhabua P.S. Case No. 71 of 2021 corresponding to Excise Case No. 122 of 2021, registered for the offence punishable under Sections 302, 328, 307 of the Indian Penal Code and section 34(b)(i)(ii)(iii) of the Bihar Prohibition & Excise Act.

As per the FIR, husband of informant and his friend died due to consumption of poisonous liquor purchased from the shop of co-accused Munna Mushar.

It is submitted on behalf of the petitioner that deceased had not purchased any liquor from the petitioner. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner's name has figured during course of investigation in confessional statement of co-

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 71 of 2021.
