JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-06-2015 Heard learned counsel for the petitioner and Mr. Ramchandra Singh learned APP for the State.

The sole petitioner prays for grant of bail in Araria P.S. Case No. 821 of 2014 registered against unknown under sections 379 and 411 IPC. A theft was committed in the shop of the informant and a motorcycle was stolen wherefrom. The allegation is that a day after the occurrence the motorcycle was found driven by one person on which the petitioner was also riding. The said motor cycle was ultimately found to be stolen one.

The contention of the petitioner is that he is in custody since 10.12.2014. He has no criminal antecedent. He was only the pillion rider of the motor cycle which does not indicate the

In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Araria P.S. Case No. 821 of 2014 (G.R.No. 4023 of 2014) on condition that one of the bailors of the petitioner shall be his own/close family member. No sooner the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates the trial court shall cancel his bail bonds.
