2. The present application has been filed for cancellation of the bail granted to the opposite party no. 2 by this Court in Cr. Misc. No. 33407 of 2013 vide order dated 03.03.2014 in connection with S.K. Puri P.S. Case No. 133 of 2013 registered for the offence under Sections 341, 323, 498(A), 506 & 34 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prhobition Act.

3. Learned counsel for the petitioner submits that vide order dated 03.03.2014, the anticipatory bail was granted to the opposite party no. 2 on the ground that the maintenance amount

Patna High Court CR. MISC. No.41707 of 2026(2) dt.15-07-2026 2/2 will be paid by the opposite party no. 2 to the informant. However, the same is not being paid by him to the informant.

4. Considering the aforesaid facts, the present application is permitted to be dismissed as withdrawn with the liberty to the petitioner to approach the concerned Court below to file an application for cancellation of bail of the opposite party no. 2 and if the same is filed the Court below will dispose of the same within one month from the date of filing. While deciding the application the Court below will consider the fact as to whether the maintenance amount is being paid to the informant or not and if the same is not being paid, the bail bonds of the opposite party no. 2 will be cancelled by the concerned Court below in accordance with law.

5. Furthermore, the concerned Court below is directed to conclude the trial in connection with S.K. Puri P.S. Case No. 133 of 2013 within six months from today.
