JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 09.07.2014 in a case punishable for the offences under Sections 379, 411, 414, 34 I.P.C. on the accusation that he was caught by the informant while he was fleeing alongwith stolen motorcycle. Learned counsel appearing for petitioner drew my attention towards Annexure-2 of the petition and submits that only mobile and some other documents have been recovered from possession of the petitioner and so far as the stolen motorcycle is concerned, according to Annexure-3 of the petition, the same was recovered at NH-28 and not from possession of the petitioner.

No.51163 of 2014 (4) dt.03-04-2015 2/2 Moreover, according to prosecution case itself, the petitioner was handed over to police by the informant himself and so far as criminal antecedent of the petitioner is concerned, he was remanded in two other cases after arrest in the present case. Considering the facts and circumstances of the case as well as period of detention of the above named petitioner in jail custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Kotwa P.S. Case No. 128 of 2014.
