2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 379/411 of the Indian Penal Code.

3. As per FIR, co-accused, Md. Kasim, who was apprehended on the spot, while in possession of stolen vehicle, disclosed the name of petitioner as one of his accomplices.

4. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner transpired in this case in the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.36161 of 2023(2) dt.31-07-2023 2/2 for anticipatory bail and submits that petitioner has got criminal antecedent of similar nature.

6. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
