The petitioner seeks bail in connection with Tatapur P. S. Case No.102 of 2020, instituted for the offences under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act. The learned counsel for the petitioner submits that the petitioner is in custody since 23.05.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that allegation as alleged in the F.I.R. is that police received secret information that prostitution racket is going on in Hotel Gallory. Accordingly, it was raided and two men and two women was found in objectionable condition in different rooms

Patna High Court CR. MISC. No.44255 of 2021(2) dt.14-12-2021 2/2 and it was disclosed that the petitioner is the owner of the hotel and run the prostitution racket.

The learned counsel for the petitioner submits that petitioner was not apprehended from the spot. He was completely unaware of the fact that such objectionable racket was going on in the hotel in connivance with the hotel staffs. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 23.05.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIIth, Bhagalpur in connection with Tatarpur P. S. Case No.102 of 2020.

The application stands allowed.
