The petitioner is in custody since 23.08.2014 in connection with Sahebganj P.S. Case No. 216 of 2013 for the offence registered under Sections 302, 201 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is not named in the First Information Report, however, the name of the petitioner has surfaced on the confessional statement of co-accused, namely, Sanjay Kumar which is no evidentiary value. It is further submitted that coaccused, namely, Sanjay Kumar has been granted bail by this court vide order dated 07.05.2015 passed in Cr. Misc. No. 48345
Patna High Court Cr.Misc. No.15480 of 2015 (3) dt.28-07-2015 of 2014 and its analogous cases. It is further submitted that the petitioner was remanded in connection with the present case while he was in custody in connection with Raxual P.S. Case No. 40 of 2014 and since then he is languishing in jail. Considering the aforementioned submissions as also the fact that petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 9th Additional District and Sessions Judge, Muzuffarpur in connection with Sahebganj P.S. Case No. 216 of 2013.
