The petitioner seeks bail in connection with Ekma P.S.Case No. 160/2015 registered for offences punishable under sections 302/34 of the Indian Penal Code.
The accusation is of firing upon the son of the informant through fire arms by accused persons. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant is not an eye witness to the occurrence rather he came to know about the occurrence from Sunny Kumar and the informant has lodged the present case against Bir Bikram Vikash Singh @ Bittu
Patna High Court Cr.Misc. No.2986 of 2016 (3) dt.18-03-2016 2/2 Singh and Chandan Singh, who had surrounded the deceased and Bittu Singh shot fire upon him . The informant disclosed the name of the petitioner in his restatement as one of the conspirator and also stated that firing was made at his son by Rabindra Prasad Sharma @ Puttul and except that there is nothing against the petitioner. Petitioner has no criminal antecedent as is evident from para-3 of this petition and the petitioner is in custody since 03.09.2015.
Considering the facts and circumstances, the above named petitioner, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Divya Prakash, Judicial Magistrate, Saran at Chapra in connection with Ekma P.S.Case No. 160 of 2015.
