2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Siwan Muffasil P.S. Case no. 258 of 2020 instituted for the offence under Sections 363, 366(A)/34 of the Indian Penal Code, which was earlier dismissed as withdrawn by this Bench on 19.07.2022.

3. The allegation against the petitioner along with others is of abducting the daughter of the informant, when she went to attend call of nature.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. The

Patna High Court CR. MISC. No.39740 of 2023(7) dt.02-02-2024 2/2 victim girl has been recovered and her statement has been recorded under Section 164 of the Cr.P.C. in which she does not whisper about the complicity of the petitioner. The victim girl further stated that she out of her own sweet-will fled away from her house and solemnized marriage with this petitioner in a temple.

5. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Siwan Muffasil P.S. Case no. 258 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan subject to the conditions as laid down under section 438(2) of the Cr.P.C.
