JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-03-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner seeks bail in a case for the offences punishable under sections 326, 327 and 34 of the I.P.C and section 27 of Arms Act.

It is submitted that the petitioner is not named in the FIR and co-accused Nagendra Sah told name of the petitioner in his confessional statement made before the police. The petitioner was in jail in Durma P.S. Case No. 118 of 2014 and from that case he has been remanded in this case, besides that he has no criminal antecedent. He has got no concern with the offence in this case. He is suffering in custody since 30.09.2014, whereas, co-accused Nagendra Sah has already been allowed bail vide Cr. Misc. No.

Patna High Court Cr.Misc. No.51933 of 2014 (3) dt.03-03-2015 2/2 34183 of 2014 by order dated 25.09.2014.

Considering that co-accused Nagendra Sah who has named the petitioner has already been allowed bail and as such the petitioner is also directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Sitamarhi in Runnisaidpur P.S. Case No. 83 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
