JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-06-2019 Having regard to the nature of dispute raised in the present writ petition, the Court is not inclined to grant any indulgence to the petitioners at this stage. However, liberty shall be available to the petitioners to file an application for registration of a regular case for removal of encroachment under the Bihar Public Land Encroachment Act.

In the event, the petitioners file application along with a copy of this order, for registering a regular case for removal of encroachment, the Circle Officer, Nokha, District- Rohtas is required to register a regular case and take necessary decision after hearing all the stakeholders including the alleged encroachers in accordance with the provisions of the Bihar

Patna High Court CWJC No.2563 of 2018(4) dt.18-06-2019 2/2 Public Land Encroachment Act. Necessary decision in this regard must be taken by the Circle Officer within a period of six months from the date of filing of the application. With the aforesaid, the writ petition stands disposed of.
