JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-08-2024 Heard Mr. Nityanand Mishra, learned counsel appearing on behalf of the petitioner, Mr. Pramod Kr. Pandey, learned APP appearing for the State and Mr. Anil Kumar Singh, learned counsel appearing on behalf of informant.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 306 of the Indian Penal Code.
3. As per prosecution case, on 01.09.2023 at about 6PM, daughter of informant told him that this petitioner has been abusing and harassing her on phone calls. Earlier, informant had fixed marriage of his daughter with this petitioner. Informant further alleges that he had given Rs. 1,11,000/- to this petitioner for marriage purpose and marriage
Patna High Court CR. MISC. No.37118 of 2024(4) dt.22-08-2024 2/3 was scheduled in the year 2024. Thereafter, due to abuse and harassment over phone calls, daughter of informant committed suicide by hanging in her house on 01.09.2023.

It is submitted by learned counsel appearing on behalf of the petitioner that the entire prosecution case is absolutely false and concocted and the same has been lodged only with ulterior motive, to extort money from the petitioner and his family members. As a matter of fact, petitioner never met daughter of informant. It is further submitted that during investigation no direct or indirect material has come against this petitioner to show that he played any active role leading the deceased to commit suicide. Petitioner claims clean antecedent.

On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that this petitioner is named in the F.I.R. and there is specific allegation against him that he used to tease the daughter of informant in abusive and filthy language, as a result of which, out of frustration, deceased committed suicide.
6. Considering the aforesaid facts and circumstances and nature of accusation, the prayer for grant of anticipatory bail
