The petitioner seeks regularization in service on the ground that he has worked in the Animal Husbandry Department till about 1996.
From going through the averments made in the petition and the counter affidavit, it appears that all efforts were made by the respondent/State to inquire and collect information with respect to the services of the petitioner in the Department of Animal Husbandry.
Patna High Court CWJC No.1845 of 2017(3) dt.18-04-2019 2/2 According to the claim of the petitioner, he last worked at Hazaribagh in the Piggery Division of the Animal Husbandry Department.
In the writ petition, no evidence or proof has been furnished with respect to the petitioner having worked on casual basis in the Animal Husbandry Department. Otherwise also, the petitioner stopped working from the year 1996 and has approached this Court for regularization of his services in the year 2017.
In the absence of any material, much less cogent material, to come to the conclusion that the petitioner had ever worked in the Animal Husbandry Department and for the claim of the petitioner for regularization to be an absolutely stale one, there is no option for this Court but to dismiss the writ petition in limine.
Writ petition is dismissed, but with no order as to costs.
