JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The alleged occurrence took place in the night of 2008-2014 and after the occurrence, the written report was given on 21-08-2014 at about, 11.50 a.m. but the informant did not disclose the name of petitioner, particularly, in the circumstance, when in course of investigation, the informant claimed that the petitioner was well-known to him and the petitioner used to visit his house oftenly. Moreover, in course of investigation, the informant and his other family members specifically stated the name of the petitioner and one other accused who happens to be full brother of the petitioner. Admittedly, nothing has been recovered from conscious possession of the petitioner.

Patna High Court Cr.Misc. No.50886 of 2014 (4) dt.01-04-2015 Accordingly, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Phulwaria P.S. Case No. 102 of 2014 to the satisfaction of Judicial Magistrate-Ist Class, Gopalganj.
