JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 22-06-2015 Heard learned counsel for the petitioner as well as learned APP for the State.
While the prosecution party conducted raid at the house of accused, Biru Kumar of Barhara PS Case no. 120/2014, found one Babla Mandal @ Bablu Mandal who raised alarm whereupon two persons who were sleeping at the verandah of Kailash Mandal began to flee, were apprehended who disclosed their identity as Biru Kumar and Saroj Kumar, accused of aforesaid Barhara PS Case No. 120/2014. Subsequently thereof, Kailash Mandal and Rameshwar Mandal raised alarm as thief attracting so many persons including female members who indulged with the prosecution party and during course thereof, managed to get the aforesaid two apprehended accused out of police custody.
Patna High Court Cr.Misc. No.16142 of 2015 (2) dt.22-06-2015 From the narration of the self-statement of the informant as well as after going through the order impugned which is based upon after perusal of the case diary, nothing specific has been alleged against the petitioners who happen to be under custody since 11.11.2014 as well as 02.12.2014 respectively. Accordingly, petitioners, namely, Rameshwar Mandal @ Kutai Mandal and Niraj Mandal @ Niraj Kumar Mandal are directed to be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Barhara PS Case no. 223/2014.
