Petitioner is in custody in connection with N.D.P.S. P.S. Case No. 04 of 2019 arising out of Marhowrah P.S. Case No. 114 of 2019 for the offence under section 120(B) of the Indian Penal Code and Section 8/20 (ii)(C)29 N.D.P.S. Act. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 2 quiental 3 kg. Ganja was seized from a truck.

Allegation against this petitioner is that he was liner in the trade of ganja.

Learned counsel for the petitioner submits that petitioner is in custody since 9.3.2019.

No.30873 of 2019(3) dt.17-08-2019 2/2 Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, N.D.P.S., Act, Saran at Chapra, in connection with NDPS Case No. 04 of 2019 arising out of Marhowrah P.S. Case No. 114 of 2019 subject to the condition that petitioner shall deposit 1,00,000/- (One lac) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
