2. In this case, the petitioner is seeking regular bail in connection with Chandauti P.S. Case No. 577 of 2023, registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.
3. As per allegation, the daughter of the informant went missing after attending coaching. Thereafter, the informant came to know that the petitioner kidnapped her daughter. It is further alleged that the informant received a call from the petitioner, who told her that he has kidnapped her daughter.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated. He is a person of clean antecedent. As a matter of fact, there was love and affection between the victim and the petitioner and the victim in
Patna High Court CR. MISC. No.37338 of 2024(3) dt.22-07-2024 2/2 her statement under Section 161 of CrPC has stated that she went with the petitioner on her own sweet will. As per Paragraph No. 17 of the case diary, the police arrested the petitioner and the victim when they were fleeing away on apprehension of being arrested.
5. On the other hand, learned APP has opposed the prayer for bail.
6. As per medical report, the victim is 19 years of age. She stated that she went with the petitioner as per her own sweet will as she had known the petitioner for three months prior to the occurrence. As per paragraph no. 17 of the case diary, the police arrested the petitioner and the victim together while they were fleeing away.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-X, Gaya in connection with Chandauti P.S. Case No. 577 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
