JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 17.07.2014 in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.
The informant's mobile and cash were robbed. The FIR was registered against unknown, subsequently, the name of the petitioner sprang up on the confession of co-accused. It is submitted by learned counsel for the petitioner that a statement has been made in para 7 of the petition that no recovery has been made from the petitioner. Moreover, the petitioner has not been put on T.I. parade. A statement to that effect has been made in para 11 of the petition. Considering the fact that the petitioner has not been put on T.I. parade, let the above named petitioner be released on bail
Patna High Court Cr.Misc. No.7452 of 2015 (2) dt.02-03-2015 2/2 on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Patna City in connection with Shahjahanpur P.S. Case No. 03 of 2014.
Since the petitioner has criminal antecedent, learned court below will be at liberty to cancel his bail bonds if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
