JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners and the State. The petitioners seek regular bail in a case registered for offences punishable under Sections 147, 341, 342, 323, 324, 307, 379, 504, 506 I.P.C.
Referring to F.I.R., learned counsel for the petitioners has submitted that there is no specific allegation of assault by the petitioners. He submits that altogether 15 persons have been named and allegations are general and omnibus. He further submits that there is a case and counter case and the petitioners' side lodged Kesariya P. S. Case No. 252 of 2013 on the same day with respect to the same occurrence. Learned counsel for the
Patna High Court Cr.Misc. No.50701 of 2014 (4) dt.03-03-2015 2/2 petitioners further submits that the injuries have been found to be simple and superficial.
Considering the facts and circumstances, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Motihari in connection with Kesariya P. S. Case No. 252/2013.
