The petitioner, who is in custody since 17.06.2020, seeks bail in connection with Thakuraha P.S. Case No. 62 of 2020 dated 16.06.2020 instituted for the offence under Sections 341, 323, 324, 307, 447, 337, 504 and 34 of the Indian Penal Code.
It appears from the FIR that while the children were playing, a fight took place in which the parties assaulted each other. The petitioner and one Gaffar Sah are said to have assaulted Ashfaque Sah which led to grievous injuries on his person.
It has been submitted on behalf of the petitioner that the parties are agnates and the informant
Patna High Court CR. MISC. No.33524 of 2020(3) dt.05-01-2021 2/2 does not wish to prosecute the petitioner and others any further.
The occurrence arose out a small issue and there does not appear to be any intention on the part of the petitioner or for that matter the other accused person who is said to have assaulted Ashfaque Sah to cause any serious injury to him.
Regard being had to the nature of accusation, the surrounding circumstances and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Thakuraha P.S.
