ANJANA MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State.
The petitioner is in custody since 10.12.2015 in connection with Raxaul P.S. Case No.292 of 2015 registered for the offences under Section 7 of the Essential Commodities Act. Learned counsel for the petitioner submits that though the allegation is of recovery of gas cylinders from the premises of the petitioner, actually the same was not recovered from his conscious possession but behind the Dak Bungalow where his house is situated. It is further submitted that the money recovered from the Kirana shop is his own currency, being the sales returns from the Kirana shop.
Considering the aforementioned facts and circumstances
Patna High Court Cr.Misc. No.3958 of 2016 (2) dt.11-02-2016 2 / 2 and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari (East Champaran), in connection with Raxaul P.S.
