JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners along with several others were caught by the police while they were carrying stolen railway wire by the stolen vehicle. Petitioners and their associates were remanded in the present case on the basis of recovery of stolen vehicle. The contention on behalf of the petitioners is that the coaccused Serajuddin having similar allegation has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 02.12.2014 passed in Cr.Misc. No. 46232 of 2014. Petitioners are languishing in jail custody since 01.08.2013.

No.51826 of 2014 (3) dt.08-04-2015 2/2 No doubt, petitioners are said to have chequered history of several cases but it appears that almost all the cases were registered against the petitioners in the year 2011. . Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S.Case No. 154 of 2011.
