The accusation is of committing dacoity in the house of the informant. The F.I.R was lodged against unknown. The name of the petitioner sprang up when the stolen mobile was recovered from the possession of the petitioner after two months of the occurrence. It is submitted by learned counsel for the petitioner that I.M.E.I number of the robbed mobile and the mobile recovered from the petitioner are different. It is further submitted that neither the petitioner nor the robbed mobile was put on T.I.P.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that petitioner was not

Case No. 47 of 2013.
