JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-420, 384/34 of the Indian Penal Code. The present occurrence appears to have taken place on 25-09-2015 whereas; the written report was given on 11-10-2015 and there is no explanation of above-said delay. Moreover, it would appear from submissions as well as materials, available in the case diary that one Majorganj P.S. Case No. 256 of 2015 was registered for kidnapping of a person and in course of investigation of aforesaid Majorganj P.S. Case No. 256 of 2015, it came to light that the petitioner as well as other accused had used the mobile phone of informant's wife but submission on behalf of

No.3578 of 2016 (5) dt.10-03-2016 petitioner is that the aforesaid mobile phone has not been recovered from conscious possession of the petitioner and so far as so-called call details is concerned; it is not specific that it was the petitioner, who used the mobile phone of informant's wife. Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the investigation of this case against the petitioner has already been completed, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Majorganj P.S.
