Petitioner is named in the first information report on the accusation that he along with others kidnapped the informant's daughter but submission on behalf of the petitioner is that the statement of victim has been recorded under Section 164 of the Cr.P.C. in which she specifically stated that she solemnized her marriage with petitioner by her own sweet will and she was never kidnapped by the petitioner. It is further submitted by him that victim was major at the time of alleged occurrence.
