====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 22-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

This is the second attempt of the petitioner for bail in Balrampur (Telta) P.S. Case No. 12 of 2001. Earlier such prayer was rejected on 04.08.2014 in Cr. Misc. No. 13584 of 2014, by which order the Court below was also directed to expedite the trial and conclude the same within six months.

Pursuant to a report called from the Court below, Letter No. 148 of 2015 dated 09.07.2015 has been received from the Additional District and Sessions Judge, IV, Katihar bringing it to the notice of the Court that the said direction of the Court earlier was not brought to his notice and has assured to conclude the trial within two months. In that view of the matter, this Court is not inclined to enlarge the petitioner on bail.

Patna High Court Cr.Misc. No.10840 of 2015 (3) dt.22-07-2015 2/2 The application accordingly stands dismissed. However, the Court below shall positively conclude the trial latest by 30th September, 2015 as per the assurance given by the Court itself. The Court makes it clear that failure to do so may result in this Court taking a strict view in the matter.
