Heard learned senior counsel for the petitioners, Mr. N.K. Agrawal and learned A.P.P. for the State. 2.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 353, 332, 333, 224 and 225 of the Indian Penal Code. 3.
Learned senior counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged

No.36821 of 2024(2) dt.14-05-2024 2/3 in the FIR, it would manifest that the allegation against the petitioners is not of dealing in illegal sale of liquor but they have been implicated in the instant case with an allegation that when the police force had gone to the house of the named accused persons for arresting them as they had assaulted chaukidar when it is alleged that the petitioner along with other accused came at the place of occurrence and pelted stones on the police and freed Kamlesh Singh and Om Prakesh Kumar, who were arrested. It is further submitted that the petitioners are neighbours of Kamlesh Singh and when the police had come to arrest him, the petitioners, being neighbours, also came out of their house to witness the occurrence but they came to be implicated. It is further submitted that no doubt the picture of the petitioners had been captured in the video recording but then the petitioners were not indulging in any overact rather were standing at the place of occurrence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.36821 of 2024(2) dt.14-05-2024 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gaighat P.S. Case No. 82 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
