It would appear that it is case of misuse of privilege of bail but admittedly, present case was lodged in the year 2002 and after that petitioner was granted privilege of bail by this court in the year 2003. Furthermore, it is an admitted position that the petitioner did his pairvi from 2003 to 2008 but the trial court could not succeed to conclude the trial of petitioner and thereafter, allegedly, petitioner jumped bail in the year 2008 and again, he was arrested on 7.9.2015 and remanded in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Kumar Krishnadeo, Judicial Magistrate, Ist Class, Supaul/ concerned court in Triveniganj P.S.
