The petitioner seeks bail in connection with Bhabua P.S. Case No. 122 of 2014 registered for the offence punishable under Section 302 read with 34 of the Indian Penal Code. According to the informant, his son Mohan Sah was burned to death by the accused persons named in the FIR including the petitioner. The petitioner is alleged to have poured petrol and co-accused Bharat Sah threw a lighted match stick on him causing extensively serious burn injuries as a result of which he died.

Regard being had to the gravity of the offence and

Patna High Court Cr.Misc. No.50757 of 2014 (3) dt.28-01-2015 2 / 2 the active role played by the petitioner in commission of the crime, I am not inclined to grant him bail. Accordingly, the prayer for bail rejected.
