Mr.Renuka Ratnakar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-03-2021 Heard Mr. Sandip Kumar Gautam, learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with R.P.F. Garhpura P. S. Case No. 60 of 2016 dated 14.09.2016, instituted for the offences under Sections 145, 146, 147, 153 and 174 of the Railway Act.

In retaliation to an accidental death on the railway tracks, approximately 500 persons are said to

The petitioners have not been named in the F.I.R. but their implication in this case is only later in point of time.

The learned counsel for the petitioners has further submitted that in an agreement between the local persons and the Railway administration, the petitioners had been a witness and therefore they have been made accused in this case.

Regard being had to the aforesaid nature of accusation against the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Barauni, Begusarai, in connection with R.P.F. Garhpura P. S. Case No. 60 of

Patna High Court CR. MISC. No.33572 of 2020(2) dt.12-03-2021 3/3 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
