JUSTICE SHIVAJI PANDEY ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Khagaria (Mufassil) P.S.Case No. 542 of 2014 registered u/s 25(1-b),A26 of the Arms Act.

Police recovered from the conscious possession of the petitioner one loaded country-made pistol along with 12 cartridges. Petitioner has criminal antecedent u/s 27 of the Arms Act. He is in custody since 26th August 2014. In the facts and circumstances of the case, petitioner Sanjay Singh is directed to be released on or after 6th April 2015 on bail, on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria

Patna High Court Cr.Misc. No.51294 of 2014 (2) dt.03-03-2015 2/2 (Mufassil) P.S.Case No. 542 of 2014, subject to the conditions that:

(i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) that the petitioner would cooperate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
