The petitioner seeks bail in Begusarai Muffasil P.S. Case No.170 of 2020 registered under Sections 341, 323, 324, 307, 387, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The gist of the allegation is that the petitioner and two others namely, Piyush Kumar and Mantun Singh surrounded the informant and asked the reason why he did not pay Rs.2.5 lacs as extortion. When the informant opposed, Piyush Kumar ordered to kill. Satyam Kumar opened fire which hit on the leg of the informant. The people gathered near the place of occurrence and brought the informant in Lakho O.P. Later on, he sent to hospital.

Patna High Court CR. MISC. No.33313 of 2020(3) dt.15-01-2021 2/2 The learned counsel for the petitioner submits that there is a counter version being Begusarai Muffasil P.S. Case No.171 of 2020. A title suit is also pending between them. The petitioner is agnate of the informant. The informant got one gun shot injury on his toe and for that the petitioner is in jail since 15.04.2020. Petitioner is in jail for last nine months. The injury is simple in nature.

Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No.170 of 2020.
