Heard learned counsel for the petitioner, learned GP23, Shri Madhaw Prasad Yadaw, assisted by Shri. Rajesh Kumar Sinha and the learned counsel appearing on behalf of the University. 2.

The Director, Higher Education in compliance of the order dated 25-11-2024, is present in the Court. The Director, Higher Education submits that Letter No. 4818 dated 27-11-2024 has been issued by her, wherein a decision has been taken that arrear pension and family pension of the petitioner will start subject to the result of L.P.A No. 666 of 2022. It is further submitted by the

Patna High Court MJC No.1494 of 2021(5) dt.28-11-2024 2/2 Director, Higher Education that the family pension of the petitioner shall commence within a period of six weeks' from today. 3.

The Director, Higher Education also submits that the Letter No. 4818 dated 27-11-2024 is annexed with the supplementary show-cause, which is being filed today in the Court. 4.

The learned counsel for the petitioner, in view of the stand taken by the Director, Higher Education in the supplementary show-cause, submits that the contempt application is not being pressed for the present, but if the family pension and the arrears are not paid within the time as stipulated by the Director, Higher Education, in that event, the petitioner would be at liberty to file a fresh contempt application. The learned counsel for the petitioner thus seeks permission to withdraw the contempt application with liberty aforesaid.

The supplementary show-cause filed on behalf of the Director, Higher Education is taken on record. 7.

The personal appearance of the Director, Higher Education is dispensed with.
