ANJANA MISHRA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Complaint Case No.17(C)/2019 for allegedly having committed the offence under Sections 363, 366A and 120B of the Indian Penal Code.

Learned counsel for the petitioners submits that these two petitioners have been named in the complaint petition and are merely distant relatives of the main accused Subash Paswan, but have been falsely implicated in the case by placing their names in the category of accused in the

Patna High Court CR. MISC. No.33194 of 2019(2) dt.20-05-2019 2/2 complaint petition. It is further submitted that the petitioners have no role to play in the entire episode, which led to the filing of the complaint case and thus may be extended the privilege of pre-arrest bail.

Considering the remoteness of the allegation, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi (Patna), in connection with Complaint Case No.17(C)/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
