This is a petition for grant of regular bail for offence under Sections 363 and 366A of the Indian Penal Code.
It has been submitted on behalf of the petitioner that as far as the petitioner is concerned, he is only alleged to have been driving the motorcycle as to when the other co-accused is said to have pulled the girl on the motorcycle. It has, further, been submitted that the other co-accused, who is alleged to have pulled the girl on motorcycle, has been granted bail by the Court below. It has, further, been submitted that the petitioner is in jail since 02.03.2015 and he has got no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the first
Patna High Court Cr.Misc. No.15860 of 2015 (2) dt.09-06-2015 2/2 information report and he has placed an active role in the said offence.
Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kishanganj P.S. Case No. 454 of 2014 to the satisfaction of the Chief Judicial Magistrate, Kishanganj.
