Petitioner is languishing in custody since 05.10.2014 in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code. Prosecution case as per the written report of the informant is that on 05.10.2014 at 7.00 A.M. the villagers informed that his brother has been killed on the land of this petitioner. The victim used work as a Night Guard in the house of the petitioner. It is also alleged that the victim used to complaint that his wife has illicit relationship with the petitioner, hence it is suspected that petitioner in conspiracy with the wife of the victim got eliminated the brother of the informant.
Patna High Court Cr.Misc. No.12625 of 2015 (3) dt.29-06-2015 It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled and there is no eye witness of the occurrence. Statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Learned A.P.P. after going though the case diary has not controverted the contention of the counsel for petitioner that there is no eye witness of the occurrence and conceded that only on suspicion the accusation has been levelled.
Considering the above mentioned facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi P.S. Case No. 124 of 2014.
