The petitioners seek bail in Gogari P.S. Case No. 38 of 2019, instituted for the offence under Section (s) 447, 341, 323, 307, 379 and 504/34 of the Indian Penal Code. Counsel for the petitioners submits that petitioners have been implicated in the instant case on account of land dispute.

It is alleged in the written report that on the date of occurrence petitioners assaulted the informant with butt of 303 on his head causing injury to him.

The injury report of the informant has been enclosed

Patna High Court CR. MISC. No.31422 of 2019(2) dt.10-05-2019 2/2 as Annexure-2 wherein the Doctor has found one lacerated wound on right side scalp measuring 5" x 1" bone deep caused by sharp cutting which was found to be grievous in nature. From the injury report it appears that there was only one injury on the person of informant whereas it is alleged that two persons assaulted the informant. There was no repetition of blow.

Petitioners are in custody since 13.2.2019 and 14.2.2019 respective having clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogari P.S. Case No. 38 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners. (Sanjay Priya, J) S.Ali/- U T
