In this case, the petitioner is seeking bail in connection with Bhabua P.S. Case No. 411 of 2015, G.R. No. 1780 of 2015 registered for offences under sections 447, 341, 323, 504, 506, 307/34 of the Indian Penal Code.
As per the allegation, the petitioner and his associates have forcibly stopped the transplantation paddy which was being made by the hired employees of informant and also allegation has been made to have assaulted with different weapons including Khanti. Against the petitioner there is allegation of threatening as well as flashing pistol at the place of occurrence. The counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.6395 of 2016 (2) dt.29-02-2016 2/2 informant and the petitioner are agnates and there is a land dispute between them.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 411 of 2015, G.R. No. 1780 of 2015, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner and (ii) if the petitioner is found involved in future in similar type of case, the court below will have liberty to cancel the bail of the petitioner.
