The petitioner seeks regular bail in connection with Bandhuwa Kurawa P.S. Case No. 44 of 2017, registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.

The allegation is regarding the son of the informant having gone with one Rajesh Hembram towards the house of the petitioner and thereafter, his dead body was found on the next day from the bush.

The learned counsel for the petitioner submits that apart from disclosure of the name of the petitioner herein by Ashok Hembram, there is no material whatsoever to connect the petitioner with the alleged crime. The petitioner is stated to be

Patna High Court Cr.Misc. No.27375 of 2018(3) dt.09-07-2018 2/2 having a clean antecedent and he is languishing in custody since 28.08.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Banka in connection with Bandhuwa Kurawa P.S. Case No. 44 of 2017. It is further directed that the petitioner would mark his attendance before the Officer-in-Charge of the concerned police station at 10:00 am. on each Monday of the week and in the event of two consecutive defaults, the present privilege of the regular bail shall stand cancelled automatically.
