Ms. Dimpal Kumari, learned Advocate for the petitioner, at the outset, has submitted that there has been a mistake in paragraph 1 of the bail application where the sessions trial number has wrongly been stated. In fact, the case has not gone in sessions trial as yet.

The petitioner seeks bail in connection with Marhowrah P.S. Case No. 116 of 2018, dated 15.03.2018, instituted for the offences under Sections 395 and 379 of

Patna High Court CR. MISC. No.33525 of 2020(2) dt.16-12-2020 2/2 the Indian Penal Code.

Though there are thirteen criminal cases pending against the petitioner, but considering the fact that in the present case, he was not named in the F.I.R. and his implication in this case is only on the basis of confession of co-accused Rakatu Rai and that the petitioner was remanded in this case from another case, this Court is inclined to grant bail to him.

Let the petitioner above-named be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-IV, Chapra, Saran/concerned Court in connection with Marhowrah P.S. Case No. 116 of 2018. While saying so, the Court has also taken note of the fact that the petitioner in this case is in custody since 09.01.2020.
