JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2020 The petitioner, who is in custody since 08.05.2020, seeks bail in connection with Rajapakar P.S. Case No. 99 of 2020, dated 08.05.2020, instituted for the offences under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act. It appears from the prosecution report that the petitioner and others were arrested from a place and from their possession, firearm weapons, cartridges and some incriminating substances were recovered.

It has been urged on behalf of the petitioner that such recovery has been forcibly foisted upon him and he has

The petitioner is in custody since 07.04.2019 and he claims to be a person of clean antecedents. Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Vaishali at Hajipur in connection with Rajapakar P.S.
