01-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Parsa Bazar P.S. Case No. 127 of 2016, registered for the offence under Section 302 / 34 of the Indian Penal Code.

As per the prosecution case, on 20.07.2016 at about 9:30 AM, the informant received an information that his daughter has been burnt to death by her in-laws members. On receipt of such information, the informant rushed there and saw the dead-body of his daughter in burnt condition and no one of her in-laws members was present there.

It is submitted on behalf of petitioner that petitioner is mother-in-law of the deceased. By referring to paragraph - 9 of the bail petition, counsel for the petitioner submits that coaccused persons namely Ram Jivan Paswan, Nagendra Paswan

Patna High Court CR. MISC. No.43729 of 2021(2) dt.01-11-2021 2/2 and Upendra Paswan have already been acquitted by the learned court below, vide judgment/order dated 16.03.2020 passed in S.T. No. 328 of 2019/S.T. No. 554 of 2019 (arising out of Parsa Bazar P.S. Case No. 127 of 2016). Petitioner is in custody since 20.01.2021.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 6th, Patna in connection with Parsa Bazar P.S. Case No. 127 of 2016.
