The petitioner is in custody since 23.11.2015 in connection Riga P.S. Case No. 293 of 2015, registered for offences punishable under Sections 414 of the Indian Penal Code and Section 25(1-b)a26/35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is alleged to have been in possession of a key of a motorcycle which is alleged to have been snatched from the Bazar area. Learned counsel for the petitioner further submits that though there is no recovery of any snatched motorcycle from the possession of the petitioner and the motorcycle which is alleged to have been recovered is that of his father, which stands justified by
Patna High Court Cr.Misc. No.3666 of 2016 (2) dt.08-02-2016 2/2 Annexure -2.
Considering the entire facts and circumstances and that the key in question is belonging to the motorcycle owned by the father of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 293 of 2015.
