The petitioner is in custody since 14.09.2015 in connection with Gwalpara P.S. Case No.84/2015 for the offences punishable under Sections 25(1-B) A, 26, 35 of the Arms Act. Learned counsel for the petitioner submits that though there is alleged recovery of one country made pistol loaded with one live cartridge, the petitioner denies the same. He further submits that on the basis of some misunderstanding, the petitioner has been taken into custody and he has nothing to do with the alleged recovered motorcycle.
Considering the aforementioned facts and circumstances of the case and also that the petitioner has been in custody for
Patna High Court Cr.Misc. No.3694 of 2016 (2) dt.08-02-2016 more than five months, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Uda-Kishunganj in connection with Gwalpara P.S. Case No. 84/2015.
