2. The petitioner seeks regular bail in connection with Hajipur P.S. Case No. 771 of 2022 lodged on 27.09.2022 under Section 392 of the Indian Penal Code.

3. As per the prosecution case, the First Information Report has been lodged against three unknown persons who have committed robbery with the informant and snatched the collected money, mobile phone and other documents.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. In fact, the petitioner is not named in the FIR, rather his name has figured in this case, on the basis of confessional statement of coaccused. He further submits that the petitioner is in custody

Patna High Court CR. MISC. No.42307 of 2023(2) dt.14-07-2023 2/2 since 27.10.2022 and apart from the present case, the petitioner is accused in six more criminal cases in which he is on bail. Moreover, section in which the petitioner has been charged is 392 which is triable by a Magistrate.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Vaishali at Hajipur, in connection with Sadar P.S. Case No. 771 of 2022 subject to the conditions as laid down under Section 437(3) of Cr.P.C.
