JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named but in course of investigation, the name of petitioner surfaced in this case and subsequently, he was arrested and confessed his guilt. The looted motorcycle was recovered in abandon condition from the road but the documents of the looted motorcycle were recovered from the room of the petitioner.

Petitioner carries criminal antecedent but submission on behalf of the petitioner is that the so-called recovery of documents from the room of the petitioner is nothing but only highhandedness of the police.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.3305 of 2016 (2) dt.03-02-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bathanaha P.S. Case No. 77 of 2015.
