JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2016 Both the above-said petitions arise out of Mahua P.S. Case No. 476 of 2015 registered under Sections-302/34 & 120(B) of the Indian Penal Code as also Section-27 of the Arms Act and accordingly, both the above-said petitions are being heard and disposed of by this common order.
Heard learned counsel for the petitioners as well as
Patna High Court Cr.Misc. No.4698 of 2016 (3) dt.29-02-2016 2/2 learned Additional Public Prosecutor for the State. Petitioner in Cr. Misc. No. 4698 of 2016 is father-inlaw whereas; petitioner in Cr. Misc. No. 4999 of 2016 is motherin-law of the deceased and according to prosecution case itself, two unknown persons shot the deceased while she was at her parent's home. The informant claims that the in-laws of the deceased were not happy with the deceased and they hatched up a conspiracy to eliminate the deceased.
In course of investigation, witnessed admitted this fact that two unknown persons committed murder of the deceased and husband of the deceased had no concern with the petitioners and he was residing at Delhi in connection with his livelihood. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mahua P.S. Case No. 476 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
